To use MOT, you must read and accept these Terms & Conditions and understand how we use your data. By proceeding, you confirm your agreement.

By using our website or engaging with us, you agree to be bound by these terms. These Terms govern your use of the platform and your interaction with Midshore Online Training (MOT).

Amendments

We may update these Terms periodically. Changes will be published on our website and apply from the date of posting. Continued use of our services constitutes acceptance. If you do not agree to the revised terms, you should cease using the website and services.


4. Intellectual Property

Website & Platform Content

All content on this website and our platforms (texts, images, logos, design, etc.) is protected. You may not reproduce, modify, copy, distribute, or use any material for commercial purposes without our express written consent.

Course Materials

Delegates are granted a non-transferable, non-exclusive licence to use course materials for personal educational use only. Course materials must not be shared, republished, or redistributed without written permission. This licence terminates upon the end of your enrolment.

Any breach of these conditions may result in legal action and the Delegate or Employer will be held liable for any resulting infringement.


5. Indemnity

You agree to indemnify Midshore, its directors, employees, and suppliers against any claims, costs, and expenses (including legal fees) arising from your breach of these Terms or misuse of our services.


6. Eligibility

Individuals under the age of 18 must obtain express permission from Midshore before using our services. 


7. Third-party Links

We may provide links to third-party websites for your convenience. Midshore does not review or endorse the content or privacy practices of these sites and is not responsible for any damage or loss resulting from their use.


8. Training Terms

Study Materials

Course materials are provided at the start of training (if live) and are not transferable.

Attendance & Substitutions (Live training)

  • Delegates must attend all required sessions and bring joining instructions.
  • Non-attendance is non-refundable and may result in a rebooking fee of £40.
  • Substitutions are allowed up to 2 business days prior to the course start free of charge; within 2 days, a £40 admin fee applies.

Security (Live training)

Delegates are responsible for their personal belongings. Midshore accepts no liability for items lost or stolen at training venues.

Course Enrolment & Access (Online training)

  • All enrolments are valid for 12 months from activation.
  • Reactivation (for another 12 months) is available for a £40 fee or the course cost, whichever is lower.
  • If a course becomes obsolete and you have 90+ days of enrolment remaining, a replacement course may be offered at a discounted rate (subject to organisational discount).

Midshore warrants:

  • Course materials will be of satisfactory quality (though not error-free)
  • Services will be delivered with reasonable skill and care

No other warranties are implied unless required by law.


14. Notices

Official notices will be served by post or email to the contact details provided by the Delegate or Employer.


15. Validity

If any part of these Terms is found to be invalid or unenforceable, the remainder shall still apply and be interpreted as closely as possible to the original intent.


16. Promotions & Discounts

Promotional offers are valid only during the specified period. If no end date is listed, Midshore reserves the right to withdraw the promotion. Promotions cannot be combined with other offers (e.g. multi-user discounts).


17. Governing Law & Jurisdiction

These Terms are governed by the laws of the Bailiwick of Guernsey. Any disputes will be subject to the exclusive jurisdiction of the Guernsey Courts.
